Terms of Sale
Version 2026-10-30. These terms apply to every purchase on YesAgain Trade Auctions — by auction, Buy Now or accepted offer.
1. Who can buy
The platform is for businesses only. You apply with your company, trade licence and VAT details; we check them and may approve, refuse or suspend any account. You are responsible for everything done under your account and must keep your details up to date.
2. The seller
Every sale is made and invoiced by YesAgain, and payment is always made to YesAgain — including lots marked "Partner stock — YesAgain guaranteed", which we sell and stand behind on behalf of our partners.
3. Bidding
- Auctions use silent proxy bidding: you set a maximum and we bid for you, one increment above the next bidder, up to that maximum. Your maximum is never shown to anyone.
- Bids are binding. A bid cannot be withdrawn or lowered once placed.
- A bid placed in the final minutes extends the auction (soft close), as shown on the lot.
- A lot may have a hidden reserve. If the reserve is not met, the lot is not sold.
- On lots sold in boxes, boxes go to the highest maximums first and every winner pays the same price per unit; units that don't fill a whole box are not offered.
- We may withdraw a lot, or cancel a bid, before the auction closes — for example in case of an obvious error or a breach of these terms.
4. Buy Now and offers
Pressing Buy Now is a binding purchase at the price shown. An offer you make is binding once we accept it; a counter-offer from us binds you once you accept it.
5. Prices, VAT and fees
Prices are in the currency shown on the lot and exclude VAT unless the lot says otherwise. VAT is charged according to the treatment shown on the lot (margin scheme, standard rate, zero-rated export or reverse charge). There is no buyer's premium. Bank charges for your payment are yours.
6. Payment
Your invoice is issued as soon as you win or buy. Pay it in full by bank transfer to YesAgain within 3 business days. Goods are released only once funds have cleared. If you don't pay on time we may cancel the sale, offer the lot to another buyer, suspend your account and claim any loss or costs this causes us.
7. Collection and delivery
Delivery terms (Incoterms) and the shipping location are shown on each lot; unless agreed otherwise, lots are sold EXW from the warehouse shown. Risk passes to you as the Incoterm says. Please arrange collection or shipping promptly after payment; storage beyond 10 business days may be charged.
8. Condition and grading
- Each lot is sold as described on its page and manifest. Grades and conditions are explained in our grading guide.
- Graded units are tested before sale. Lots marked As-is, Fault found or Faulty / parts are sold exactly as they are, with no returns.
- Incoming lots are stock we have ordered but not yet received; they ship once they arrive. If incoming stock does not arrive, or arrives materially different from the description, we may cancel the affected units and refund what you paid for them.
- Photos are representative unless a lot says they show the actual units.
9. Claims
For graded lots, tell us within 7 days of receiving the goods if units are missing, are a different model, or don't work as their grade describes — with the serial numbers and photos. We will check and, at our choice, repair, replace or credit the affected units. We can't accept claims for as-is, fault found or faulty lots, or for damage after delivery.
10. Liability
Our total liability for a lot is limited to the price you paid for the affected units. We are not liable for indirect loss such as lost profit or resale value. Nothing in these terms limits liability that cannot be limited by law.
11. Your data
How we use your details is set out in our Privacy notice. Auction alerts are part of the service; marketing messages are sent only if you opt in, and you can opt out at any time.
12. Changes and law
We may update these terms; the version in force when you bid or buy applies to that purchase. These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai have jurisdiction.
